1. Introduction
These Terms and Conditions govern your use of emotionalhealthcoachacademy.com and any materials, products or services provided by Positively Blooming Ltd. By using this site you signify your assent and agreement to these Terms and Conditions in full. If you do not agree, discontinue use of this site and its materials immediately.

The following definitions are used throughout this agreement.
Materials — Training courses provided by Positively Blooming Ltd (emotionalhealthcoachacademy.com). This may include but is not limited to databases, audio and video recordings, written materials and visuals, frameworks, processes, scripts, activities and exercises, and all derivative works, enhancements, or any other modifications to the above.
Databases, Site — means the current and future electronic means of hosting and accessing the Materials above, which may change form from time to time.

3. Restrictions on Use of Materials
Materials, Databases and Site are copyrighted and all rights are reserved. Text, graphics, databases, HTML code, and other intellectual property are protected by United Kingdom and International Copyright Laws, and may not be copied, reprinted, published, reengineered, translated, hosted, or otherwise distributed by any means without explicit permission from Positively Blooming Ltd. All trademarks on this site are trademarks of Positively Blooming Ltd or of other owners used with their permission.

4. Database Ownership, Licence, and Use
Materials, Databases and Site are the sole intellectual property of Positively Blooming Ltd and no transfer of ownership is implied in this agreement. Positively Blooming Ltd and its contributors reserve all rights and no intellectual property rights are conferred by this agreement.

Positively Blooming Ltd grants you a non-exclusive, non-transferable licence to use the database(s) accessible to you subject to these Terms and Conditions. The database(s) may be used only for viewing information or for extracting information to the extent described below.

You agree to use information obtained from these databases only for your own private use or the internal purposes of your home or business, provided that use does not involve the selling or brokering of information. You may not cause or permit any part of the databases to be published, printed, downloaded, transmitted, distributed, reengineered, or reproduced in any form (whether directly or in condensed, selective or tabulated form) whether for resale, republishing, redistribution, viewing, or otherwise.

You may on an occasional and limited basis download or print out individual pages of information that have been individually selected to meet a specific, identifiable need, for your personal use only or for internal business use on a confidential basis. You may make a limited number of duplicates of any output, in machine-readable or hard copy form, as may be reasonable for these purposes only.

Nothing herein shall authorise you to create any materials, database, directory or hard copy publication from the databases or materials, whether for internal or external distribution or use.

5. Terms of Booking and Refunds
All sales are considered final 7 days from the date of payment being received. Should you request a refund on or before 7 days from the date of sale, you must supply written notice of that request by email to hello@emotionalhealthcoachacademy.com. All cancellations and refunds must be authorised by Positively Blooming Ltd.

Further requirements anconditions for cancellation requests:

Written detailed reasons for cancellation must accompany your written notice of cancellation.
A copy of your sales receipt indicating payment type must accompany your written notice of cancellation.
Your name, address, telephone number and email address must be clearly legible within your written notice of cancellation.

Approval of Refund Requests
There will be no consideration or authorisation for a refund without meeting all cancellation requirements and conditions outlined above.

Upon approval of a refund request, any payments made will be refunded within 10 business days.
Positively Blooming Ltd will not be responsible for honouring refunds that do not follow the process outlined above.

6. Liability
The materials on this site are provided "as is" and without warranties of any kind, either express or implied. Positively Blooming Ltd disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. Positively Blooming Ltd does not warrant that the functions contained in the materials will be uninterrupted or error-free, that defects will be corrected, or that this site or the server that makes it available are free of viruses or other harmful components.

Positively Blooming Ltd does not warrant or make any representations regarding the use or results of the use of the materials on this site in terms of their correctness, accuracy, or reliability. You assume the entire cost of all necessary servicing, repair or correction. Applicable law may not allow the exclusion of implied warranties, so the above exclusion may not apply to you.

Under no circumstances, including but not limited to negligence, shall Positively Blooming Ltd be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site. Applicable law may not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you. In no event shall Positively Blooming Ltd's total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing this site.

12. Termination
These Terms and Conditions are effective until terminated by either party. You may terminate this agreement at any time by destroying all materials obtained from emotionalhealthcoachacademy.com and all copies thereof. This agreement will terminate immediately without notice at Positively Blooming Ltd's sole discretion should you fail to comply with any term or provision of this agreement. Upon termination, you must destroy all materials obtained from this site and all copies thereof.
